Real Estate Law For The Real World
PERSISTENCE | PROFESSIONALISM | PASSION
Richard D. Lom, Esq. CCIM
Because of Richard’s lengthy background in commercial real estate, he’s been exposed to an endless list of legal issues involving residential and commercial transactions for nearly 30 years. His family has been associated with the real estate investment side since 1944—a family busines in which Richard is still very much active. From Richard’s early days as a mortgage originator with Plaza Funding, to running his own residential brokerage (Estate Source), Richard continues to serve his Lexington commercial clients, in both the practice of law and as the Principal Broker of his own property management firm, LOM Properties, LLC. Richard is proud to have earned his CCIM from the Ward Center of Real Estate Studies and his Juris Doctorate from NKU, Salmon P. Chase College of Law. To his credit, Richard is one, of only a handful, of professional property managers in the country who is a Principal Broker, a CCIM and an Attorney.
Practice Areas
Real Estate Law can be rather complex because it often involves two or more parties governed by federal statutes, as well as regulations and laws from state to state, county to county and even city to city. The scope of Real Estate Law is also extremely vast, incorporating a wide variety of issues including, but not limited to, protection from creditors, banking & financing, usage rights, landlord-tenant relationships, condemnation, leasing & purchasing, title disputes, zoning laws and a long list of other matters.
We provide a wide range of legal services to individuals and businesses in Kentucky including but not limited to:
LANDLORD-TENANT
Landlord-Tenant representation typically falls into two general categories: (1) resolving disputes between landlords and tenants, and (2) assisting either tenants or landlords in the drafting, negotiation and enforcement of lease agreements.
TRANSACTIONS & CONTRACTS
Richard is very experienced at drafting and reviewing the many contracts related to real estate transactions. From simple purchase and lease agreements, to complex, multi-party REA agreements in Kentucky.
SECURING FINANCING
Richard David Lom represents investors and end-users in the securing of financing for a real estate acquisitions, and further assists his clients in understanding the litany of terms in a financing agreement.
LAND USE AND ZONING
Zoning laws in Kentucky can be incredibly confusing, especially if things are not going your way. If you are currently trying to expand a business, develop real property, or open a new venture, land use or zoning restrictions may hinder or put an immediate stop to your endeavors.
TRUSTS & ESTATES
If you or your family business has real estate assets, proper estate planning is a must to achieve significant estate tax advantages. Such estate planning is also critical because without an estate succession plan, your real estate assets may be subject to unclear ownership or undue tax burdens.
